Director Trade Compliance

Location : San Jose, CA

Our client company is a worldwide leader in the design and manufacture of microcontrollers, advanced logic, mixed-signal, nonvolatile memory and radio frequency (RF) components. Leveraging one of the broadest intellectual property (IP) technology portfolios in the industry, the company provides the electronics industry with complete system solutions focused on consumer, industrial, security, communications, computing and automotive markets. Responsibilities: The Director, Trade Compliance will
assist the Director of Corporate Legal Affairs in developing, enhancing, implementing and managing the company's global export compliance program including screening systems, policies and training, and other export compliance related matters.

Assist the Director of Corporate Legal Affairs with the compliance with U.S. and foreign export regulations, including, without limitation, administration of the company's export compliance program, management and implementation of export management systems (e.g. product and technology classification, order processing, recordkeeping, auditing, monitoring and screening);

  • Review, identify, document and regularly audit product and technology export classifications;
  • Prepare and file for commodity classifications and/or commodity jurisdiction requests as necessary and maintain adequate technical and legal backup documentation;
  • Develop and implement,export compliance policies, programs, processes, procedures, tools and templates;
  • Conduct regular export compliance process reviews and internal audits across all operating units to assure export compliance effectiveness and identify areas of weakness for improvement;
  • Develop, manage and supervise automated solutions relating to export transactions, order processing, screening and licensing;
  • Work with relevant departments and employees involved in export compliance to provide guidance and direction with respect to export compliance and license requirements for commodities, software and technology;
  • Draft, amend and file export licenses and seek required government approvals;
  • Coordinate with the HR department with respect to “deemed export” compliance;
  • Maintain, register and renew DDTC, D-Trade, SNAP-R and other government registrations;
  • Actively participate in industry groups and trade associations;
  • Develop, implement, and maintain training programs for employees and business managers involved in export compliance related activities.

Mandatory Skills :

  • Knowledge of U.S. export control regulations to include Export Administration Regulations (EAR), International Traffic in Arms Regulations (ITAR),and regulations of the Office of Foreign Assets Control(OFAC);
  • Familiarity with export control and technology transfer restrictions under European Community regulations and similar regulations in Asian countries;
  • Expertise in Export Management Systems(EMS) Guidelines and implementation
  • Ability to work with individuals with respect to product classifications and to draft related technical backup memos
  • Industry knowledge of semiconductor, GPS, telecommunications, aerospace, satellite, encryption, security and other technologies subject to export controls.
  • Proven experience building and implementing internal compliance programs.
  • Ability to integrate effective compliance requirements with on-going business processes
  • Strong communication & interpersonal skills. Solid analytical & problem solving skills
  • Preferred Skills :
  • Technical and electrical engineering expertise in the technology industry is preferred, especially related to integrated circuits Education: Bachelor of Science or Engineering degree required Experience:
  • 8+ years in export controls compliance and global project management.
  • Experience in preparing Manufacturing License Agreements, Technical Assistance Agreements and other documents related to export licenses and applications
  • Experience in preparing commodity jurisdiction and commodity classification requests
