Trade Compliance Manager

Reports to VP Logistics, with a dotted line to the Director of Compliance
No Direct reports
Location: Lawrence, MA (north of Boston)

The successful candidate will have the ability to establish and manage import and export compliance activities in a global organization with at least five years experience leading a global trade program. Extensive knowledge and understanding of US Customs and Border Protection, US Department of Commerce, NAFTA, HTSUS and other international trade laws and regulations is essential. Working knowledge and familiarity with EAR, US Department of Treasury sanction programs, anti-boycotting provisions, the Bureau of Census, and Foreign Trade Statistics Regulations (FTSR) desired. Brokerage or other trade operational experience desired; knowledge of corporate trade compliance programs and issues required; working familiarity with export control regulations desired.

Responsibilities:

  • Direct and supervise Company’s Import/Export Trade Compliance Program.
  • Responsible for all NAFTA transactions/compliance.
  • Review and provide guidance on Trade Agreements, including US Free Trade Agreements.
  • Facilitate and anticipate the need for export and import licenses, including working knowledge of ECCN and deemed export compliance.
  • Manage compliance with US Import and Export Regulations as required both domestically and globally.
  • Institute and preserve a strong network of operational processes and controls around import and export activities, including import controls, export licensing, classifications, all deemed export compliance, import/export documentation, import/export violation and disclosure processes.
  • Responsible for implementing processes to ensure products area correctly classified under the Harmonized Tariff Schedule of the United States (HTSUS) and Schedule B for export.
  • Responsible for each location’s strategic use of duty free programs, i.e., NAFTA, broker management, and FTZ.
  • Review of special Trade program eligibility and corresponding documentations in support of duty-free entry and/or reduced and recovered duty payments for eligible products (e.g. NAFTA, Duty Drawback, First Sale, etc.) for Import/Export Operations in the recovery of import dollars from U.S. Customs.
  • Develop and manage trade compliance policies and procedures and compliance manual.
  • Manage internal and external compliance reviews and audits, and research, write and submit Binding Ruling requests, with samples, to US Customs from time to time.
  • Advise management about trade regulation changes.
  • Oversee implementation of trade compliance programs for acquisitions.
  • Serve as main point of contact for Customs and other government agencies. Coordinate compliance with related and unrelated trade partners (domestic and foreign), ensuring priorities set by Logistics (Imports) and Customer Service (Exports) are met.
  • Manage customs brokers and other trade related providers.
  • Review and give guidance on the impact of licensing, royalties and samples on customs value.
  • Implement consistent SOPs for customs brokers and freight forwarders. Manage customs broker and freight forwarder compliance with corporate policies, processes, and procedures and perform assessments.
  • Maintain, design, select and successfully implement applicable import/export systems including ERP systems and WMS.

Requirements:

  • A Bachelor’s Degree is required. A minimum of five years of progressively responsible experience is required.
  • Demonstrated knowledge and abilities in the following areas is preferred: U.S. CBP ISA Program, Importer Security Filing Rules and Regulations, CTPAT, Foreign Trade Zones, Customs Bonded Warehouse, Antidumping, Drawback, and Reconciliation.
  • In-depth working knowledge of U.S. Customs regulations. Ability to understand technical product features and functionalities and determine related import requirements. Knowledgeable in U.S. export regulations (e.g. ITAR, EAR, sanctioned party screening, and anti-boycott restrictions) highly desired.

Qualifications:

  • A minimum of a BS/BA degree required
  • Experience as a trade compliance team lead or management role preferred.
  • Extensive experience in lieu of BS/BA degree will be considered - Licensed Customs Broker preferred.
  • Experience developing and managing an import and export compliance program - Strong import classification experience essential.
